Privacy notice

This notice explains the information MyDefectCase collects, why it is used, and the choices available to potential clients.

Information we collect

We collect account credentials; name, mailing address, email address, and phone number; the address of the property at issue; information about a potential defendant; your description of the problem; follow-up answers; and files you choose to upload, including documents, photographs, and video. We also maintain technical records needed to secure and operate the service.

How information is used

Information is used to create and secure your account, organize a potential construction defect matter, assign Bates identifiers, generate source-linked summaries and timelines, identify follow-up questions, prepare reports and presentations, and allow a prospective attorney to review materials that you approve for sharing.

Automated analysis

When automated analysis is enabled, uploaded files and relevant case context may be transmitted to OpenAI through its business API for processing. AI output can be inaccurate. MyDefectCase is designed to ask you to confirm important identities, dates, image descriptions, and factual propositions before they are treated as confirmed. Remote analysis files are deleted after processing unless the operator intentionally enables retention.

Address and business-record services

Property address searches may use OpenStreetMap's Nominatim service. Links to BBB, Google Maps or business listings, and secretary of state searches open those third-party services, which receive the search terms and are governed by their own privacy practices.

Sharing and publication

Your private workspace is account-gated. A case presentation becomes accessible by link only after you publish it, and it includes only files selected for presentation. Anyone who receives that link may be able to view the approved material, so share it carefully. Submitting information does not create an attorney-client relationship or guarantee representation.

Retention and security

Information is retained while needed to provide the service, evaluate a potential matter, meet legal obligations, resolve disputes, and maintain security. Administrative, technical, and physical safeguards are used, but no system can guarantee absolute security. The operator should establish matter-specific retention and deletion periods before broad public use.

Your choices

You may choose not to publish a presentation and may limit which evidence appears in it. To request access, correction, export, or deletion of your information, contact privacy@mydefectcase.com. Some records may need to be retained where required by law or legitimate security needs.

Children and changes

The service is not directed to children under 18. This notice may change as the platform, service providers, or legal requirements evolve; the effective date above will be updated when material changes are made.
